Form I-864: already in effect since August 31, 2026
USCIS's revised Form I-864 (edition 08/24/26) has been in effect since August 31, 2026, with zero grace period, replacing the 10/17/24 edition. Form I-864 is the Affidavit of Support: the sponsor's promise to financially support the immigrant spouse. It is required in every marriage-based case.
The new version adds a privacy release letting USCIS pull the sponsor's credit report from consumer reporting agencies, so a credit freeze can hold up review. It also updates Form I-864A and Form I-864EZ. USCIS's 2026 income floor for a sponsor's household of two is $27,050, per the official USCIS alert.

Form I-765: new edition effective September 15, 2026
USCIS's new Form I-765 (edition 09/15/26) takes effect September 15, 2026, with zero grace period, replacing the 08/21/25 edition. Form I-765 is the work permit application, officially the Employment Authorization Document (EAD). For a marriage green card, it's filed under category (c)(9) alongside Form I-485.
The revision implements the fixed period of admission rule for F and J nonimmigrant students, exchange visitors, and foreign information-media representatives. It replaces the old open-ended Duration of Status with a specific end date, and was published alongside a new Form I-539.
The I-765 filing fee is $260. It has not been free since April 2024, per the official USCIS alert.

Form I-485: new edition effective September 18, 2026
USCIS's new Form I-485 (edition 09/18/26) takes effect September 18, 2026, with zero grace period, replacing the 01/20/25 edition. Form I-485 is the green card application. Every applicant adjusting status (getting a green card from inside the United States) must file it.
The revision aligns Form I-485 with the 2026 Public Charge Ground of Inadmissibility Final Rule, a rule about whether an applicant may depend on certain government benefits. It adds new questions about means-tested public benefits, household income, and financial resources, per the official USCIS alert.

What this means for a marriage green card packet
A marriage-based adjustment of status packet usually bundles several forms in one mailing: Form I-130, Form I-485, Form I-864, Form I-765, and often Form I-131. USCIS checks each form's edition date separately at intake. It won't average them out or give you partial credit.
Because these three forms have three different effective dates, the safe edition for each one depends on the exact day you mail or e-file, not on which forms you file together.

One outdated form rejects the whole packet

The postmark date (or your e-filing date, for online submissions) controls which edition USCIS accepts. If your packet is postmarked before a form's cutoff date, that form's older edition is still accepted even if the packet physically arrives after the cutoff.
