Why USCIS Form Editions Matter (And What Happens During a Rejection)

Every government form carries an edition date at the bottom of each page. When your package reaches a USCIS lockbox, intake clerks check that date before any officer looks at your eligibility.

An outdated edition gets your filing rejected at the lockbox. A rejection is not the same as a denial:

• No decision on the merits: USCIS never opens the case. It doesn't evaluate your marriage or your eligibility.
• No fees charged: Your filing fee check or payment form is returned uncashed or uncharged.
• The entire packet is returned: USCIS mails everything back with Form I-797C (Notice of Action), citing the expired edition.

A rejection still causes real problems for couples:

• Resets your timeline: Adds 3 to 6 weeks before you're back in the queue.
• Extra paperwork: You must reprint and re-sign the entire packet.
• Status risk: If your visa or I-94 expires while the rejected package is in transit, you could fall out of status.

Why Did USCIS Update Form I-485? The Public Charge Final Rule

Under U.S. immigration law, an applicant likely to become primarily dependent on the government for subsistence is inadmissible under the public charge ground (section 212(a)(4) of the Immigration and Nationality Act).

USCIS updated Form I-485 to match the 2026 Public Charge Ground of Inadmissibility Final Rule, effective September 18, 2026. It rescinds the 2022 rule, restores a broad, case-by-case totality-of-the-circumstances standard, and changes how applicants report public benefits, household income, and financial resources.

The 2026 rule widens the range of benefits USCIS may consider, so older guidance about which benefits are safe is out of date. Here is what marriage green card applicants should understand:

• What USCIS may consider: for benefits received on or after September 18, 2026, USCIS guidance says any means-tested public benefit can be relevant, including cash assistance, food assistance (SNAP), government-funded health coverage such as non-emergency Medicaid, public or assisted housing, and financial aid for postsecondary education.
• What is not counted: Social Security, Medicare, and unemployment insurance are earned benefits, not means-tested. Benefits received by your relatives or children are generally not attributed to you.
• The financial sponsor requirement: family-based applicants must submit a sufficient Form I-864 (Affidavit of Support) from the U.S. sponsor. Under the 2026 rule, a sufficient I-864 is one important factor, not an automatic guarantee. USCIS still weighs the statutory factors (age, health, family status, financial status, and education and skills), and a missing or insufficient I-864, when one is required, makes the applicant inadmissible.

What If You Already Mailed Your Application?

If you mailed your Form I-485 with the 01/20/25 edition before September 18, 2026, you are in the clear. USCIS accepts it based on the postmark date, even if it physically arrives at the lockbox after September 18.

Save your postal tracking receipt showing the postmark date. It's your proof of when the package entered the mail stream if USCIS ever questions the timing.
