USCIS September 2026 Filing Deadlines: Which Edition to Use
Three forms in a marriage green card packet change edition this month, each on its own date and each with no grace period. Here is exactly which edition to file, based on the day you mail.

What to do before you file
Four steps, in order, to keep your packet from bouncing at the lockbox.

Check the table for your mail date
Pick the date you realistically expect to mail or e-file, then note the edition each form needs on that day.

Download every form fresh the day you print
Editions change without much notice. A PDF you saved weeks ago may already be stale. Print all pages of each form from the same current edition.

Verify the footer on every page
The edition date sits in the footer of each page in MM/DD/YY form. Every page of a given form must show the same date, or USCIS rejects the whole form.

Mail with a dated postmark and keep the receipt
Use USPS Certified Mail, FedEx, or UPS. The carrier's dated record is your postmark and it controls, even if the packet arrives later. Keep it.
Do not file the new edition early
The deadline works in both directions. USCIS says plainly: do not file the 09/15/26 forms before September 15, and do not file the 09/18/26 edition before September 18. A new edition mailed before its own effective date is rejected the same way an old one is after.
USCIS posts preview copies of new editions so applicants can prepare, but a preview filed early still bounces. Match the edition to your actual mail date, not to the date you printed the form.

Already have a case pending? You do not need to refile.
The edition rule is applied once, when USCIS accepts your filing. If your I-485 or I-765 was already accepted before its cutoff, it keeps the edition you filed. You do not refile on the new edition, and USCIS does not reject an accepted case for using the earlier one.
Common edge cases
- You already printed and signed the old edition. If your postmark is before the cutoff, it is still accepted. On or after the cutoff, reprint and re-sign the new edition.
- Your packet is already sealed and in the mail. The postmark controls, not the arrival date. Postmarked before the cutoff means it is accepted even if it lands at the lockbox later.
- You use FedEx or UPS instead of USPS. Keep the dated drop-off or pickup receipt as proof of when you filed, and mail well before the cutoff so the timing is never in question.
A rejection is not a denial
A wrong-edition filing is rejected at intake, not denied. USCIS returns the packet unadjudicated, does not cash your fees, and issues no receipt number. It is not a strike against your case.
It still costs you weeks. You reprint on the correct edition, re-sign, reassemble, and re-mail, and your place in line starts from the new filing date. That delay is exactly what the table above helps you avoid.
Watch this before September 15
The September 15 date could still move
As of September 5, 2026, the fixed period of admission rule behind the September 15 Form I-765 edition is being challenged in federal court (Presidents' Alliance v. DHS, District of Massachusetts). A hearing was held September 3, 2026 with no ruling yet, so the September 15 date could change if the court acts. The September 18 public charge rule behind the new Form I-485 edition has no known court challenge. Check the USCIS alerts page before you mail.
The September 30 deadline only matters for some couples
The State Department publishes a monthly chart called the visa bulletin, a waiting-list schedule that controls when green cards in capped categories can move forward. It drives the September 30 fiscal-year cutoff, but only for some couples.
If your sponsor (the U.S. citizen or green card holder spouse) is a U.S. citizen, your case is an immediate-relative green card, called IR1 or CR1. There is no annual cap and no waiting-list line, so the fiscal-year date does not change your filing math.
If your sponsor is a green card holder, you are in the F2A category, the capped waiting-list line for spouses of green card holders, and the visa bulletin can affect when you file. Only that group needs to weigh the September 30 cutoff. The edition deadlines above apply to everyone either way.

My I-485 or I-765 is already pending. Do I need to refile on the new edition?
No. USCIS applies the edition rule when it accepts your filing. A case already accepted keeps the edition you filed, and you do not refile.
Can I file the new edition early to be safe?
No. USCIS says do not file the 09/15/26 forms before September 15, or the 09/18/26 edition before September 18. A new edition filed before its effective date is rejected too.
I already printed and signed the old edition. Is it still valid?
If your postmark is before the form's cutoff, yes. On or after the cutoff, reprint and re-sign the new edition, because USCIS decides by postmark date.
